GENERAL TERMS
1. The online Store ArtStore 24, operating at www.artstore24.ch (hereinafter referred to as the Store) is run by the company ArtStore 24 Artur Kowalski (hereinafter referred to as ArtStore 24). with headquarters in Wiesentalstrasse 13, 8962 Bergdietikon
2. The Products term means all the things available in the Store, presented on the website www.artstore24.ch.
3. The Buyer term means a company or a private person who intends to make purchases in the ArtStore 24 online Store at www.artstore24.ch.
4. To use the online Store you need: a computer with Internet access and a browser such as: Firefox, Chrome, Internet Explorer or Opera in a version not older than 2010, as well as having an active e-mail account.
5. ArtStore 24 reserves the right to change the general conditions at any time. The conditions available on the website are the only ones obligatory at the time of purchase.
6. The Products offer in the Store is addressed to Buyers with the address of residence or the company's headquarters in Switzerland and Liechtenstein.
7. The Store allows the possibility of ordering a wholesale quantity of Products, as well as the possibility of sending Products outside the countries indicated in point 6. Such orders should be sent to the address office@artstore24.ch. The terms of such orders will be agreed individually with the Buyer.
PRODUCT DESCRIPTION AND PRICE
1. The subject of the contract is the Products listed in the order and in the order confirmation at the retail prices given in the online Store.
2. ArtStore 24 reserves the right to errors, especially if they relate to the availability and quantity of goods in the Store.
3. The appearance of the ordered Products is based on their descriptions placed in the online Store. Product photos posted on the website are for
illustration only and may differ from the original Product, e.g. in shade of color. weight, dimensions etc. are as accurate as possible but may vary slightly, which in turn is not a Product defect.
4. The presentation of Products on the website is an online catalog , not a legally binding offer.
5. The price given for each Product is in CH
6. The price given for each Product is binding upon placing the order by the Buyer.
7. The price does not include the delivery fee. The cost of delivery will be added to the value of the purchased goods when the Buyer chooses the type of delivery.
8. Information on the available types of delivery and shipping costs can be found on the Store's website in the Payment and Shipping policy section.
9. The Store reserves the right to change the prices of goods and introduce new goods. The right to change the price does not affect the price of the goods covered by the order placed before the change.
ORDER RULES
1. No registration is required to process the order, while to complete the order please provide true and complete information, i.e:
• first name and last name,
• correspondence address (delivery address),
• e-mail address,
• phone number.
2. In the case of non-standard orders made by e-mail, please provide, in addition to the data listed in point 1 information about:
• commodity of interest to the Buyer, including its identification by indicating a four or five-digit code (given on the Product card) and its quantity,
• the price of the goods.
3. If the Buyer fails to provide the data referred to in point 1 and 2, the order will not be accepted for execution.
4. The Buyer is obliged to keep his login details confidential to prevent unauthorized access by third parties.
5. The Buyer can place orders 24 hours a day via the Store's website.
6. The Buyer chooses Products, places them in the basket, accepts the rules of the online Store as well as privacy policy and cookies. The Buyer confirms the contents of the basket, supplements the data necessary to complete the order listed in point 1 and proceeds to payment. After sending the order, the Buyer receives an e-mail confirmation of the order being accepted by the Store.
7. The email message referred to in point 6, contains information about the order number and its essential components, which include: name of the Product (s) along with the reference number (four-digit or five-digit code), price, delivery costs, chosen payment method, Buyer's data including delivery address.
8. Confirmation of order acceptance does not mean acceptance of the contract for implementation.
9. The official confirmation of purchase is the confirmation of shipment.
10. Shipping is always after payment confirmation:
• through the system of fast electronic PayPal transfers - after receiving the payment, the Store confirms the correct execution of the payment, or after posting the amount due on the Store's account,
• by direct payment to the Store's account - after the Store receives confirmation of the correct execution of the payment, or after posting the amount due on the Store's account.
11. If the Product is not available (out of stock), the Store will inform the Buyer. In this case, the Store has the right to withdraw from the contract, and if the Buyer has paid for the goods, the Store will refund the money to the account indicated by the Buyer.
12. In case of temporary unavailability of the goods, the Store may offer to buy another or ship the ordered goods at a later date, provided that the Buyer agrees. Lack of consent of the Buyer causes the Store's right to withdraw from the contract and the obligation to return the money received to the account indicated by the Buyer. Further claims against the Store are unfounded.
PAYMENT METHODS
1. The Store offers the following payment methods:
• through the system of fast electronic PayPal transfers,
• payment by traditional transfer to the Store's account kept by Raiffeisen Bank, account number CH48 8080 8003 6550 9048 1
2. The Store accepts payments only in CHF.
3. The Store does not accept cash payments.
ORDER REALIZATION
1. The Store dispatches orders via Swiss Post. Detailed information on delivery methods can be found in the Payment and Shipping Policy section
2. The Store is not responsible for non-delivery of goods or delay in delivery caused by incorrect or inaccurate address provided by the Buyer
3. The Store is not responsible for the inability to deliver the goods caused by the inability of the post car to arrive at the place of delivery (no road, road too narrow, etc.). In the case of additional costs of such delivery, these costs are borne by the Buyer.
4. If the Buyer fails to collect the goods within the agreed delivery time, the goods will be returned to the Store and the Buyer will be charged with return shipping.
5. Re-delivery of unclaimed goods to the Buyer will result in additional delivery costs being charged.
CHECK GOODS OBLIGATION
1. Buyers are obliged to check the delivered and received Products for damage to the packaging and Product damage.
2. Any Products damaged in transport should be immediately reported to the Store and recorded on the supplier's shipping documents.
3. Goods damage, incorrect and incomplete orders should be reported to the Store within 5 calendar days of receipt or delivery.
4. Reports should be send by email to office@artstore24.ch
5. If the goods are delivered with visible damage in transit, please immediately submit a complaint to the shipping company and contact us as soon as possible.
6. If the Buyer does not make a complaint about transport damage or do not contact us, this will not affect the Buyer's statutory warranty rights. However, after receiving the notification, we can more easily make our own claims against the forwarder or the insurance company.
WARRANTY
1. Crystal, glass and ceramic Products do not have a manufacturer's warranty, which also excludes the Store's liability.
2. Discounted Products are wholesome Products and have no defects
3. Products with slight visual defects or have been repaired are marked in the Store as defective goods by an appropriate note in the Product description. Customers buying these Products are aware of the defects and the Store is not responsible for the defects
LIABILITY AND DISCLAIMER
1. Liability is governed by applicable statutory provisions.
2. Art Store 24 is not liable for any damages caused by improper storage, use, cleaning and repair or modification of the Product by the Buyer or third parties,
3. Art Store 24 is not responsible for force majeure, especially environment, humidity, falls and impacts etc. that were not caused by fault and at the headquarters of Art Store 24.
4. The service provider is responsible for any damages caused during the delivery.
RETURN POLICY
1. The Buyer has the right to return the Product from within 14 days of the day of receipt without giving a reason. Product return is possible provided that the goods are undamaged and have not been used.
2. Returned Product and the invoice should be sent to: Art Store24 Artur Kowalski Wiesentalstrasse 13,8962 Bergdietikon enclosing a return form.
3. Returned Products should be safely packed in their original packaging. Damaged Products will not be picked up or the Buyer will be charged.
4. The Store guarantees a refund of the Product price, the return does not include shipping costs. The return package costs are covered by the Buyer. The Store does not accept COD shipments.
5. The money will be sent back immediately, but not later than within 14 days of the Buyer's submission of a return form.
6. The Store is obliged to return the payment using the same method of payment that the Buyer used, unless the Buyer explicitly agrees to a different return method that is costless.
COMPLAINTS
1. The Store is obliged to deliver items free from physical defects. In the event of non-compliance of the goods with the contract (having physical defects), the Buyer has the right to complain about the goods within 2 years from the date of purchase.
2. The complained goods should be sent to the address: Art Store 24 Artur Kowalski with the note "Complaint" with the invoice and complain letter.
3. Wear and consequences of improper or careless use, neglected maintenance and attempted repair by the Buyer or third parties are not defects.
4. When purchasing, the Buyer undertakes to use the Products only as intended.
5. The right to request a price reduction or return is not entitled to the Buyer if the Store immediately and without undue inconvenience to the Buyer replaces the defective item with a non-defective one or removes the defect.
6. The Store considers the complaint within 14 days of the date of receipt.
7. If the complaint is accepted, the Store, depending on the Buyer's request, will replace the goods with a new one, and if the above proves impossible (goods unavailable), it will refund the full amount or propose other goods available in the Store; or in the case of a request to reduce the price or return, reimburse the amount paid by the Buyer in whole or in part. If the complaint is accepted, the Store will reimburse the costs of sending the returned goods incurred by the Buyer.
APPLICABLE LAW AND JURISDICTION
1. The contractual relationship, including these terms and conditions, is exclusively governed by Swiss law, excluding the conflict-of-law provisions of Swiss private international law, in particular the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Law).
